Employees are supposed to speak up when they see something wrong in their workplace. This is doubly true when people could be hurt, or even killed, if the problem is allowed to persist. This is why whistleblower laws have been enacted. Workers should be able to point out danger or illegality without having to worry about being fired for doing so.
The Tata Group is a multinational conglomerate that owns Jaguar Land Rover and has ties to Vietnamese automaker VinFast. The company fired one of its mechanical engineers, Hazar Denli, and there is reason to believe that the dismissal might be an example of illegal retaliation. Denli, a chassis design specialist, had reported safety concerns to federal authorities regarding components in VinFast’s electric vehicles, including flaws in the suspension system.
While working on VinFast electric cars, Denli identified improperly designed components within the chassis that could compromise the vehicle's safety and performance. Believing these flaws posed a risk to drivers, Denli initially reported his concerns through internal channels at the Tata Group and VinFast. However, he felt his warnings were not adequately addressed.
Frustrated with the lack of action, Denli anonymously shared his concerns on Reddit to raise public awareness. The Tata Group identified him as the poster and terminated his employment, citing breaches of confidentiality.
Before publicly speaking to the BBC, Denli made formal whistleblower disclosures to the Securities and Exchange Commission (SEC) and the National Highway Traffic Safety Administration (NHTSA). These agencies are key channels for reporting potential violations of laws governing financial disclosure and vehicle safety, respectively. These agencies also provide protection to whistleblowers through the Dodd-Frank Act (SEC) and the Motor Vehicle Safety Whistleblower Act (NHTSA).
The allegations raise serious questions about the safety of electric vehicles manufactured by VinFast, and the company’s willingness to comply with American law concerning required disclosures and whistleblower rights. Denli’s story also sheds light on the risks whistleblowers take to prioritize public safety over corporate interests. Companies must foster environments where employees can report safety concerns without fear of retaliation.
