DOJ Antitrust Division Teams with Post Office for New Whistleblower Program

Price-fixing, collusion and other tactics that run afoul of antitrust laws harm consumers and the overall economy. Of course, companies don’t advertise when they’re engaging in monopolistic tactics or working with competitors to close off a market. Now, in the wake of numerous other successful federal whistleblower programs, the Justice Department is giving people who are aware of antitrust violations a chance to report misconduct and possibly collect compensation for doing so.
The Whistleblower Rewards Program established by the DOJ’s Antitrust Division incentivizes individuals to come forward with evidence of antitrust crimes in a broad range of industries. One interesting element of this effort is that the U.S. Postal Inspection Service and the USPS Inspector General will also play a role. By pooling resources with the Antitrust Division, these agencies hope to cast a wider net, uncover sophisticated cartel conduct, bid-rigging schemes and unlawful practices that may otherwise go undetected.
Whistleblowers can submit credible information about antitrust offenses directly to the Antitrust Division via secure postal routes or online portals. Eligible individuals may receive between 15 and 30 percent of any government recovery that exceeds $1 million. The information must be original and supported by evidence. Copies of communications, bidding documents, invoices or other records that show collusion or unfair market manipulation might be critical to the government’s case.
An experienced whistleblower attorney can advise on the best way to frame your report, as well the legal protections that exist for people in your position. Don’t hesitate to contact a lawyer because others might have similar knowledge and if they notify the authorities first, you likely will be barred from any financial recovery.
Your report should contain detailed information about the companies and individuals involved, as well as the ways in which you think their actions were anti-competitive. When possible, you should try to draw a link from the misconduct to higher prices and/or reduced customer choice.
